Five-Oh'sTerms of Service

For Buyers

Registration is free and only registerd users may buy or sell Gigs on Five-Oh
Services sold on Five-Oh are called Gigs and all Gigs are offered at a fixed price of R50
Top Sellers may sell their Gigs in multiples of R50
Once an order has been placed all sellers are obligated to fulfull any orders and may not attempt to cancel it intentionally
Gigs can be ordered by using the Order Now button and users may not offer or accept payments using any methods other than placing an order through Five-Oh
Buyers automatically received all rights for the gigs delivered, unless otherwise specified by the seller in the gig description

For Sellers

Every Gig that you sell and deliver, will credit your account with R40 - that is R50 minus the Five-Oh commission
All buyers will pay for Gigs in advance
We only credit your account once you have completed and delivered the order
Sellers may withdraw their earnings to a Alert Pay account of their choice according to the terms specified below
Should an order be cancelled for any reason, all monies paid will be returned to the buyer
A Seller's rating is calculated based on feedback recived from buyers, amount of orders delivered or cancelled and late deliveries

Order Handling

When a Gig gets ordered, the seller will get notified by Email.
Sellers are required to meet the delivery date specified during the creation of their Gig. Failure to deliver on time entitles the buyer to cancel the order and will reduce the seller's rating.
Both buyers and sellers have the option to cancel an order by mutual agreement. Doing so will have no negative effect on either party.
Mutual cancellation requests that are not answered will automatically come into effect after 48 hours and will reduce the rating of the non-responding user.
A Seller may cancel an order at any time,however cancelling an order will have a negative effect on the seller's rating.

Do's and Dont's

Buyers and sellers may not communicate via private email addresses, Skype or any other means of communication outside of Five-oh. You may not provide any personal contact details other than your name
All communications and information and file exhange shall be performed exlusively by using the Five-Oh messaging system
You are not allowed to post adult, illegal, abusive, improper, copyright protected, promotional, spam, or violent material of any nature. Doing so will get your account permanently blocked.

Gig Delivery & Communications

It is your responsibility to scan all transferred files for viruses and malware before you either upload or download it
Five-Oh will not be held responsible for any damages that might translate due to site usage or use of user transferred content or materials
Sellers shall deliver completed files and proof of work using the Deliver Completed Work tab located on the Order Page
Once work has been delivered, the buyer will have 3 days to respond. After that time, the order will be considered as complete and marked accordingly

Withdrawing revenue

To withdraw money from your account you will need a valid Alertpay account. You can sign up for an Alertpay account here : AlertPay
Your Five-Oh account can only be associated with one Alertpay account, this association is permanent and cannot be changed.
Revenue in your account will only be made available for withdrawal after a safety clearance period of 14 days. This is for your protection as well as ours.
Revenuw withdrawals can only be done once you have accumulated R100 or more in your account. The higher the amount you withdraw in one transaction, the less charges you will have to pay so it makes sense to wait until you have accrued a sensible amount of revenue in your account before withdrawing it. Withdrawals are final and cannot be undone. No refunds or changes will be able to be affected once the process has begun.

Buyers

Ordering Gigs

Buyers may purchase Gigs either using a Credit Card or Alertpay
Once payment is confirmed, your order will be created
Should you have a positive balance of R50 or more it will automatically be applied to any new Gigs you order
As a Buyer your indentity is anonymous at all times. Please refrain from requesting or sharing any personal contact details as all transactions are to be done via Five-Oh's communication system
You may not offer or use any other payment system other than that offered by Five - Oh
You may not pay sellers directly using their Alertpay account or any other account. In case you have been offered an alternative payment method, please report it immediately here: Report Abuse
Should you have a dispute with a seller, please file the dispute with Five-Oh and not with Alertpay or your bank
In case of a problem, please try and work things out with your seller first. Should you not get any satisfaction by going that route, you may contact us for assistance via our customre support here: Customer Support
Customer support for complaints is only valid up to a period of 10 days from completion date. After that period of time we will not be able to cancel orders.

Shipping

Should your purchased Gig require physical delivery ( arts & crafts, collectable items etc) the seller may decide to add additional charges for shipping. Sellers may add shipping prices for local or international shipping.
When a buyer buys a Gig which needs to be deliverd physically, the buyer will be required to provide a shipping address. The Seller will be responsible for all shipping arrangements once the Buyers supplies the shipping address. Under no circumstances will Five-Oh be responsible for any delivery problems caused and we shall not be responsible for tracking or quality and condition of items shipped by the Seller.
Tracking numbers are a great way to avoid disputes related to shipping so it is recommended that the Seller enters a tracking number if available in the order page when delivering Gigs.

General Terms & Conditions

Violation of Five-Oh's Terms & Conditions could get your account permanently blocked
Sellers will be able to withdraw any revenue from blocked accounts after a safety period of 45 - 90 days, depending on the reason the account was blocked, from day of last cleared payment received in their account and subject to Five-Oh's approval
Disputes should be handled using Five-Oh's dispute resolution tools i.e Got Problems? in the order page or by contacting Five_Oh's customer support
Five-Oh reserves the right to put on hold or permanently cancel any account due to misbehaviour. Users who have accounts on hold will nto be able to trade on Five-Oh in any way or form
Five-Oh reserves the right to amend its Terms of Service from time to time. Changes will be available at http://www.five-oh.co.za/termsofservice
Usage of Five-Oh after the date on which the Terms of Service may have changed serves as your agreement and acceptance of any changes that may have been made

Disputes

We encourage you to make use of our internal system to try and settle conflicts and disputes amongts themselves. However, if for any reason negotiation between a Buyer and Seller fail, you can contact Five-Oh's customer service here: Customer Service.
Five-Oh will not refund payments made for canclled orders back to Alertpay or the buyer's credit card. Refunds will be made to the buyers Five-Oh account

Ownership & Limitations

Unless clearly stated in the Gig description, the buyer is granted all intellectual property rights, including but not limited to copyrights for the work delivered from the seller and the seller waives any and all moral rights therein. For peace of mind, when custom work is created, such as artwork, design work, any written work etc. the completed work shall be the exclusive property of the buyer. The seller expressly agrees to assign the buyer the copyright to the completed work and extends to the the buyer to the fullest extent possible under the law, all of its rights, title and interest if any in and to the delivered service and waives any and all moral or monetary rights in connection therewith.

The Seller further asserts that any information which was received from the buyer which does not fall under public domain shall not be used for any purpose whatsoever than the delivery of the work to the buyer.

By offering a service the Seller asserts that it has sufficient permissions to provide, sell or resell the service that they offer on Five -Oh.
